Membership
Any person applying for membership agrees to support our objectives and agree to follow our Constitution, Code of Ethics and following Terms and Conditions as outlined below.
- Your BOINZ membership will commence upon full and final payment and following Board Approval.
- Your fees are pro rated based on the month of application through to 31 December.
- All membership types pay a one-off joining fee (as listed against Membership Types). This reflects administration costs associated with joining the Institute.
- If payment is not made within the required 3 month grace period, memberships will cease.
- All memberships are non transferable and non refundable once payment has been received.

Use of the Institute's Name and Logo
Any Member of BOINZ agrees to seek permission through the Chief Executive for the Board approval to use the BOINZ name and logo, including any BOINZ subsidiaries, branding and logos.

This document provides guidelines on appropriate use of the BOINZ name and logo when associated with the purchase of membership, partnerships and promotional rights in relation to events and engagements.
The BOINZ name and logo, including all subsidiaries, shall not be used without the prior specific written approval of the Chief Executive of the Board. The rules and regulations surrounding this means a company cannot be listed as being a Member of BOINZ.
- The only acceptable use of the Institute's name is for a Licensed Member to state the following:
Licensed Member of The Building Officials Institute of New Zealand or LMBOINZ - The only acceptable use of the Institute's name is for an Accredited Member to state the following:
Accredited Member of The Building Officials Institute of New Zealand or AMBOINZ. - The only acceptable use of the Institute's name is for a Corporate Member to state the following:
Corporate Member of The Building Officials Institute of New Zealand or CBOINZ.
No Member of BOINZ can align the BOINZ logo or name with references to training, skills or expertise without prior written approval from the Chief Executive of the Board.
The use of the BOINZ logo on any material, including but not limited to websites, business collateral or vehicles is not permitted without prior written approval of the Chief Executive of the Board. Similarly the incorporation of the BOINZ name, or image cannot be aligned or linked with any other imagery, logo or company name.

Events
Confirmation Policy
Once registered, all delegates will receive a confirmation by email. This will contain all relevant details and information regarding the event and about future communications as well as the registrant's confirmed details. On receiving a confirmation email, this means the registration has been processed, and any cancellation policies will be enforced.
Cancellations Policy
All cancellations must be received in writing by the Institute and receive a written acknowledgement in return.
All cancellations:
- must be received in writing by the Institute and receive a written acknowledgement back.
- Up until 60 days prior to the event will incur an admin fee of $225+GST
- 30 – 60 days before the event will incur 50% registration charge
- 15-30 days before the event will incur a 75% registration charge
- 15 days or less will incur a full registration charge
A Substitution:
- will be accepted but will incur a processing fee of $85+GST.
- the registered delegate MUST be the person attending on the day, unless prior arrangements have already been made with the Institute.
- any unadvised or unregistered substitutions who arrive on the day will be invoiced at the full registration rate for period that they are in attendance.
Payment of Registration
All delegate registration invoices must be paid prior to the start of the event. Registrants will not be allowed to attend if their registration invoices are outstanding. Exhibitors must also be paid in full before the start of the event unless a prior arrangement has been made.
Unable to attend Social Functions
If you are unable to attend any of the social functions at the conference which are inclusive of all full registrations then, for catering and other purposes, it would be appreciated if you could send a brief email indicating this to events@boinz.org.nz
Conditions of Attendance
Attendees registering for events including those attending as partners or at selected social events are reminded that they must not promote products and services to those registered at conference, unless they are attending as an exhibitor. Anyone wishing to promote products and services are required to apply for an exhibition stand. The Building Officials Institute reserves the right to restrict access or expel individuals breaching this requirement.
Travel and Accommodation
If booking travel and accommodation to attend an event, it is important that you book travel and accommodation that can be refunded or transferred in the event of postponement or cancellation. The Institute will not be held responsible for any costs incurred.
Partner's Social Registration
Access to the Partners Social Programme is for members/delegates attending the conference, their spouses and exhibitor staff spouses only.
Member's Discount
In order to claim the member's discounted rate for attendance at this event, attendees must be current financial members of the Institute. Please check that your membership is current with no outstanding subscriptions due. Members who are not financial at the time of this event may incur an additional charge.
Early Bird Special
The Early Bird special rates are only available until the date indicated on the registration form and/or website. Any registrations received after this date will classify as a 'Late Standard' registration.
Exhibitor's Rules, Regulations and Contract
Registered Exhibitors are bound to comply with strict rules and regulation as part of their exhibition contract.

Photography & Filming
For promotional purposes, there may be a professional photographer and video production taking place during BOINZ events. Delegates who do not wish to be filmed or recorded should advise the organisers by email to events@boinz.org.nz prior to the event. By registering for any BOINZ event you authorise BOINZ to take photos at the event. BOINZ is the owner of the copyright and photographs and that it may use the photographs for any purpose it considers appropriate, including publicity, education, in our publications, on our website, across social media platforms, or in any third-party publication or other activities and may earn income for BOINZ own benefit.
Training Academy Terms & Conditions
Registration Agreement

Building Officials Institute of New Zealand (BOINZ) courses are open to the general public, however, participants must be at least 18 years of age.
-
All courses are offered as continuing education courses unless clearly specified in the course’s description.

Course duration is effective from the later of:
- The date that the participant receives access to the e-learning materials (course materials), and
- The date upon which BOINZ receives and processes the participant’s payment for the course fees in full.

When registered for a course, the participant warrants to BOINZ that all information provided is complete and accurate.
-
When registering for a course, the participant will supply a suitable email contact so that prior to the course start date, an email containing relevant course information can be sent to the participant.
Acceptance of Terms and Conditions

The participant’s registration for any training with BOINZ constitutes acceptance by the participant of these terms and conditions.

BOINZ reserves the right, at any time, to modify, alter or update these terms and conditions without prior notice. Modifications, alterations or updates shall become effective immediately upon the participant being informed of these modifications, alterations or updates. A participant’s continued engagement with BOINZ after modifications, alterations or updates are notified constitutes an acknowledgement and acceptance of the modifications, alterations or updates.
Payment

Payment in full is required at the time of registration.

Payment must be made via credit card through the BOINZ Online Training Academy website unless otherwise agreed between BOINZ and the participant. There is a 2.5% surcharge to payments made using a credit card. All fees are billed in New Zealand Dollars.

The participant accepts that they are required to pay the full amount of the course fees even if they do not complete the course.
Member Investment Eligibility
-
To claim the Institute’s Member’s discounted rate for attendance at any event, attendees must be current financial members of the Institute. Please check that your membership is current with no outstanding subscriptions due. Members who are non-financial at the time of the event they have been registered for may incur an additional charge.
Refund Policy
-
Should a participant need to cancel their attendance prior to an event for which they have registered, notice of this with a valid reason must be received in writing by the Training Academy. The Training Academy will decide whether the reason is valid.

The following fees will be applied to cancellations:
- 15-120 working days’ notice: 25% cancellation fee
- 10-14 working days’ notice: 30% cancellation fee
- 2-9 working days’ notice: 50% cancellation fee
- 24 hours’ notice: no refund
- No show: no refund
- No valid reason for non-attendance: no refund.

If a participant withdraws from a course, the Training Academy may accept a substitute who meets the course criteria. In the case of a substitution, there is no cancellation fee.

If a participant wishes to withdraw from a course, they can transfer their fees to another available course of the same or a greater price without incurring a cancellation fee. If the new course fee is greater, the participant must pay the fee difference before attending the new course.

Course transfers and substitutions incur a $75.00 (GST exclusive) administration fee.
-
Course transfers are not applicable as soon as the participant accesses the course materials.
Course Cancellations and postponements
-
BOINZ courses require minimum numbers of attendees to be registered for viability purposes prior to the event starting. Should minimum registration numbers not be reached for an event, BOINZ will make its best endeavours to reschedule the event or offer participants a suitable alternative such as a transfer or credit note or, if all participants agree to it, running the course at a slightly higher fee. In the case of face-to-face events, potential attendees will be advised two weeks prior to an event of the event’s potential cancellation due to minimum numbers not being reached.

When booking travel and accommodation to attend a course, participants should book travel and accommodation that can be refunded or transferred in the event of postponement or cancellation. While making its best endeavours to ensure events proceed as scheduled, The Training Academy will not be held responsible for any costs incurred.
Course Content

BOINZ will make all reasonable efforts to deliver the course as outlined on the website.

BOINZ reserves the right to make reasonable amendments and updates to the content and syllabus of a course when necessary.
-
The suggested duration of a course is to be used as an indication of the amount of time required to complete the course.
-
To ensure participants can successfully participate in BOINZ online courses, participants should review the performance of their technology.
Continuing Professional Development (CPD) Points*
-
Where Training Academy training events are allocated CPD points, these points will be recorded by the Training Academy and certificates will be provided after course completion. *CPD programme is in review (December 2024).
Copyright & prohibition on plagiarism of course materials

The participant acknowledges that copyright in all of the course materials is owned by BOINZ and registration is deemed to be acknowledgement.
-
Participants are authorised to use the course materials solely for the purposes of undertaking the course.
-
Participants may use BOINZ course materials for their own personal study and educational purposes only, and BOINZ grants the participant a limited, non-exclusive licence for these purposes. This licence does not include a right to:
- Use, reproduce, duplicate, modify, alter, adapt, or amend any such course materials or any of the underlying materials in any way, whether directly or indirectly,
-
Asset ownership or rights in respect of any course materials, and/or
-
Disseminate, distribute or provide course materials to any third party, including within a participant’s organisation and/or to a participant’s employer.

Without limiting clause 27 in these terms and conditions, participants shall not copy (electronically or in hard copy) any of the course materials or any part of the course materials, or share the course materials or any part of the course materials with any other person.

Participants shall be liable for any and all loss or damage which may be caused to BOINZ by:
- The participant’s storage, use or sharing of the course materials or part thereof, and
-
The storage, use or sharing of the course materials or part thereof, by any other person where that person acquires the course materials from the participant or via access to the participant’s account where that access was achieved due to an act or omission by the participant.

Without prejudice to clause 29 in these terms and conditions, the participant indemnifies and keeps indemnified BOINZ from and against all costs, claims, demands, liabilities, expenses (including legal expenses), damages or losses arising out of or in connection with any act, omission, default or breach of its obligations to BOINZ, in respect of the course materials.
Limitation of Liability

While all reasonable care will be taken in the preparation of the course materials, BOINZ accepts no liability whatsoever for any consequence (direct or indirect) as a result of the use of the course materials. The participant indemnifies BOINZ (and BOINZ officers, employees and agents) from any liabilities, claims, costs, loss (including consequential loss) or damage suffered or caused by reason of the participant’s use of the course materials.
External Websites

BOINZ’s websites may contain links to other websites or materials over which BOINZ does not have control (External Websites). BOINZ is not responsible for and makes no representations or warranties in relation to the content of such External Websites, and such links to not constitute an endorsement by BOINZ of the content contained in those External Websites. A participant’s use of External Websites is at their own risk and is subject to the terms and conditions of use and privacy policies located on those External Websites.
Information and Privacy

BOINZ will make reasonable efforts to keep any information on participants secure and to ensure BOINZ employees or agents who have access to this information do not conduct any unauthorised use, modification, reproduction or disclosure of that information.

For the purpose of facilitating the efficient running of BOINZ, the participant authorises BOINZ to:
- collect all information BOINZ may require from any third parties and the participant authorises those third parties to release that information to BOINZ
-
hold all information given by a participant or any third parties to BOINZ, and
-
use that information, including giving information to any other person to facilitate collection of debts from a participant.

The information will be collected, held and used on the condition that:
- BOINZ will use reasonable endeavours to hold it securely, and
-
It will be accessible to any of the BOINZ employees and agents who need access to it for the efficient running of BOINZ, and
-
A participant may request access to and correction of it at any time.

BOINZ may send a participant information such as newsletters, updates and other material that may be relevant or of interest to a participant. Unless a participant informs BOINZ otherwise, BOINZ will assume that the participant agrees to receive this information.
Waiver and Forbearance

All BOINZ’s rights will remain in full force despite any delay in enforcement under these terms and conditions. BOINZ will not be deemed to have waived any right unless that waiver is in writing and signed by a duly authorised officer of BOINZ. Any waiver will apply only to the particular matter in respect of which it is given.
Entire Contract

BOINZ and the participant agree that these terms express the complete agreement between them in relation to the relevant online course. There has been no representation made by either party to the other except as expressly set out in these terms and conditions.
Governing Law
-
These terms and conditions are to be governed by and construed in accordance with the laws of New Zealand.
Straight Up Magazine
The views expressed in Straight Up are not necessarily those of the Building Officials Institute of New Zealand, nor does the advertisement of any product or service in this magazine imply endorsement of it by the Institute. ISSN 2230-2654 (online) and ISSN 1175-9739. Copyright Building Officials Institute of New Zealand. All material appearing in Straight Up is copyright and cannot be reproduced without prior permission of the publisher.
Advertising
Advertising in any of the BOINZ publications, hard copy or electronic, will be invoiced on acceptance of copy and becomes payable on receipt of invoice.
Sponsorship and Partnerships
Sponsorship and Partnerships are dealt with on a case-by-case basis as per agreement reached.
Payment of Accounts
Accounts may be paid by credit card, electronic transfer or automatic payment and are due upon receipt of invoice. Please ensure you include the invoice number with your payment.
Credit card payments can be made. Please note there is a 2.5% surcharge to payments made using a credit card.
Overdue Accounts
In the absence of special arrangements, we do not allow a credit facility. Overdue accounts are deemed to be those accounts that remain unpaid after thirty days from the date of invoice for services provided by BOINZ.
BOINZ reserves the right to refer overdue accounts to an external debt collection agency. Collection costs incurred by BOINZ for the collection of any overdue accounts will be the responsibility of the debtor and all charges must be paid in full at the time of collection.
Responsibility
BOINZ will endeavour to ensure a full professional approach to all services provided. However, BOINZ shall not be liable for any consequences of the provision of services to you, except for consequences arising as a direct result of the wilful negligence on the part of BOINZ.
BOINZ Website Usage
The materials on the BOINZ website are intended to provide general information only and may not necessarily be accurate or current. This site may contain links or other references to other parties and their websites. BOINZ cannot control the contents of those other sites, and makes no guarantee about the accuracy, timeliness or subject matter of the material located on those sites. BOINZ does not necessarily approve of, endorse or sponsor any content or material on those sites.
BOINZ makes no guarantees or representations that material on other websites to which this website is linked does not infringe the intellectual property rights of any person anywhere in the world. BOINZ is not, and must not be taken to be, authorising infringement of any intellectual property rights contained in material or other sites by linking or allowing links to, this website to such material on other sites.

Acknowledgement of Terms
This document, along with the BOINZ Code of Ethics contains the terms upon which BOINZ provides services to you.
Unless you formally advise otherwise, your continued association and use of the website will be taken by BOINZ as your acceptance of these terms.
