A house which was at the centre of a lawsuit over an agent's omission that it had major weathertightness issues should not be labelled a leaky home, its owner says.

Ashley and Suzanne Carson own 2B Edgecumbe Street in Hamilton, a house in Whitiora whose previous owner Jean Warburton discovered six monthsafter purchase was leaky and needed repairs worth $500,000.

Warburton sued REMAX real estate agent Corina Mansell who sold her the house without disclosing the leaks, a property inspector Tony Bankier who gave a satisfactory pre-sale building inspection report, and builder Matt Carson for allegedly doing unconsented work repairing a balcony and one wall on the property. The case was settled before it reached Hamilton High Court.

Mansell has pleaded guilty to "disgraceful conduct" to the Real Estate Authority.

Stuff understands the Carsons bought the Edgecumbe St house off Jean Warburton in a settlement.

Builder Matt Carson is the son of new owners, Ashley and Suzanne Carson.

They have now listed the home on the market.

When Stuff phoned Ashley Carson he disagreed that the Edgecumbe St home was leaky.

"It's sort of been labelled as a leaky home but it never was a leaky home.

"People let it go in the past four or five years, and it needs a bathroom, but that's not a leaky home."

Twelve or 15 years ago it met all the requirements of building standards, Carson said.
