Session 1: Granny Flats exemption: practical implementation and enforcement challenges, 4 June
The "Granny Flats" exemption rules came into force on 15 January 2026. This seminar will explore the practical implementation and enforcement challenges that are developing. It is aimed at those involved in developing policies and processes in the building and enforcement areas, council officers who process PIM applications, and building control officers involved in issuing notices to fix. The session will include:
- An overview of the key elements of the legislation and MBIE's Guidance.
- General challenges arising from a lack of public awareness / misinformation of the exemption rules.
- PIMs: Required information and the statutory 10-day turn-around timeframe. Overlap between building and planning rules.
- Building enforcement: When to consider issuing infringement notices and notices to fix.
- Liability: The 'good faith' defence and potential risk of more claims based on a duty to issue a notice to fix.
Session 2: Self-certification, 18 June
An overview of the self-certification schemes for plumbers and gasfitters, and the planned broader self-certification scheme for licensed building practitioners and building companies. This session will include:
- An outline of the opt-in schemes and what they aim to achieve.
- The potential uptake and impact of the schemes.
- Legal liability issues for those who opt in to the scheme
- What about the owner and future purchasers?
- The role of councils - what we expect to see and any legal liability issues.
Session 3: Proportionate liability, 2 July
An overview of the planned new proportional liability settings. What do we know so far, and how is likely to operate in practice?
- What might any caps on liability, in particular for councils, be?
- What will it mean to building parties?
- Will insurance products be available and be affordable?
- Where will it leave the homeowner and subsequent purchasers if things go wrong, and building parties are insolvent or do not have adequate insurance?
