Rice Speir Building Changes Seminar 1: Granny Flats exemption: practical implementation and enforcement challenges
The "Granny Flats" exemption rules came into force on 15 January 2026. This webinar will explore the practical implementation and enforcement challenges that are developing.
This session is aimed at those involved in developing policies and processes in the building and enforcement areas, council officers who process PIM applications, and building control officers involved in issuing notices to fix.
The session will include:
- An overview of the key elements of the legislation and MBIE's Guidance.
- General challenges arising from a lack of public awareness / misinformation of the exemption rules.
- PIMs: Required information and the statutory 10-day turn-around timeframe. Overlap between building and planning rules.
- Building enforcement: When to consider issuing infringement notices and notices to fix.
- Liability: The 'good faith' defence and potential risk of more claims based on a duty to issue a notice to fix.
