Welcome

Chairperson Stu Chapman welcomed everybody to the meeting and advised he was pleased to see such a great turnout. Chairperson then thanked Brendan Monaghan for organising the venue and Michael Marron for supplying lunch. Then agenda for the meeting was read out.

Previous Minutes

Communication around the new Diploma was raised. Mike Nesbit advised there appears to be confusion and lack of communication between Otago Polytechnic, Future Skills and BOINZ.

Course dates and locations have not been clear or provided in a timely manner, course content appears to be outdated. An independent enquiry around this is underway.

Correspondence In/Out

Southern Branch received a letter in from Jayson Ellis Timaru District Council (New board Member for BOINZ) advising any queries and matters the branch may have, Jayson can pass on to the board.

Guest Speakers

The Chair welcomed lawyer - Michael Morris from Invercargill City Council.

Michael spoke on issuing of LACC’s (Local Authority Compliance Certificate) and issues that have arisen as a result of the way the law has been written under the Sale and Supply of Alcohol Act 2012. The current Act makes it very difficult for buildings that were built prior to the introduction of the Building Code to meet the requirements of the Building Code. They are hoping the wording will be a changed to Building Act instead of the Building Code.

Michael Morris explained that a determination from law firm Simpson Grierson was sought and then agreed with Invercargill City Council position that using Section 112 should be used for assessing buildings built prior to the introduction of the Building Code.

New Buildings not having a Code Compliance Certificate issued prior to opening, it was suggested a Certificate of Public Use needs to be applied for. At first Simpson Grierson did not agree with this but following more extensive analysis of Section 363 of the Building Act, Simpson Grierson now agree this method is correct when issuing a LACC.

Special Licences do not require an LACC.

Michael Morris also spoke on the Invercargill Stadium collapse following the snow fall in 2011 and the subsequent rebuild.

Although the Invercargill District Council issued the CCC for the original building prior to receiving the Producer Statement, they were reluctant to issue the CCC for the new Stadium until they had received the Producer Statements.

General Discussions Items

1) A determination was sought on Council’s decision. The determination timeframe was drawn out and MBIE’s advice was to not rely solely on producer statements. This decision was pulled back. The decision to decline the CCC was wrong, more information around the PS4’s should have obtained. PS4’s cannot be accepted on their own.

2) Peter Gallagher from the Timaru District Council spoke on issues surrounding the discharge point for uncontrolled heat sources. At this stage a definite answer sought from MBIE has not been obtained. A further discussion around the quality of stainless steel flexi flue pipes currently being produced took place and it would appear some do not meet the requirements of the Durability Clause of the New Zealand Building Code. Invercargill District Council advised they do not allow flexi flue pipes to be used in the installation of wood burners in masonry chimneys.

Michael Marron suggested one could issue a Notice to Fix to the manufacturer or supplier under Section 14(g) of the Building Act. If there was a product concern

Russell Paterson advised Gore District Council, currently carry out two inspections for inbuilt wood burners.

General Business

The Chair asked members to please let him know if there were any issues then would like raised at future meetings or any guest speakers/topics the Branch should Invite to address at these Training and Networking meetings.

Gas Boiler Installation

General discussion took place around Gas Boiler installation and whether certain work could be classified as “exempt work” if it affected an existing fire wall.

Careers

Discussion took place around promoting Building Control Officers as a career option and whether this should be promoted further by BOINZ, LGNZ and MBIE.

The group broke for lunch at approximately 12.00pm.

Site Visit

The group visited the Niagara Timber Remanufacturing Plant. This was an informative and interesting visit, which highlighted the strength of this Industry.

Southern Branch chairperson Stu Chapman closed the meeting at 3.00pm and thanked all the speakers for there informative presentations.

Next Meeting

The next meeting will be on the 14th of September 2018 at the Timaru District Council (Council Chambers) 10.00am Start. It is hoped to have a site visit through the Holcim Cement Plant at the Timaru Port at 1.00pm. We will require the names of people attending and everybody is required to provide hard hats, vests and safety boots.
